Each of our cases starts with a free case evaluation, where we will listen to your story and offer you advice on how your case may be resolved. If you choose to work with our law firm, we will investigate the underlying facts of the charge against you, working to develop evidence that may be used in your defense. At the same time, we will perform legal research to determine if there may be a legal defense to the charges.

Throughout the process, we will negotiate with the prosecutor. In some situations, early intervention in the case may allow our legal team to convince the prosecutor to not bring charges against you. If charges are filed, we will work hard to achieve a favorable outcome, whether that be a reduction in the charges, a plea deal, or an outright dismissal.

What You Can Expect

Criminal procedure is a complex animal. Even when two individuals are charged with the same offense, each case may have a number of differences, such as: 

  • How the arrest was executed;
  • How the property and effects of the person were searched and/or seized;
  • Booking procedures;
  • Grand jury proceedings;
  • How the indictment or information was drafted; and
  • The time required to bring the case to trial.

Each of these subtle variations can dramatically alter the “signature” of a case. No two criminal cases – or criminal defendants – are the same.

A defense attorney must rely upon the rules of procedure, federal and state case law, and your constitutional rights to help you build a strong foundation for your defense. A skilled San Antonio criminal defense lawyer will analyze the facts of the case and then apply Texas law to those facts to put together a strong defense.

Depending on the facts of your case, our team may be able to file a number of motions to protect your constitutional rights. For example, if the police illegally stopped you on suspicion of driving while intoxicated, we may file a motion to suppress the evidence obtained as a result of that violation. If the state seeks to introduce certain types of evidence at trial (such as prior bad acts), we may use the rules of evidence to ask the court to limit this type of evidence.

By carefully examining the case and preparing for litigation, we strive to be sure that every defense and constitutional protection available to you is brought to bear on the Government. Whenever possible, we work to achieve a resolution without taking the case to trial.
